Smith vs. WCAB (1981)

123 Cal.App.3d 763

This case established as a case of first impression - the principle that to prove an intoxication defense, the defense need only show that the intoxication was a "substantial" cause of the injury, not the sole cause. The finding by the Fifth District Court of Appeals has been cited by the California Supreme approvingly several times and remains the standard on such cases.
